Article 1 : Introduction
These terms and conditions apply between the Fraicolo E.U.R.L. company, with its head office at 10 avenue Réaumur, 92140 Clamart, France, registered at Nanterre with the number 503 049 496 00014 (« We ») and any personn visiting our web site or buying a product on our web site ("You") www.pantalonthai.com.
Anyone can read these terms and conditions on the web site www.pantalonthai.com (« Website »). These terms and conditions car be modified, and the applicable conditions are those published on the Website the day your purchase is made.
Article 2 : Contract
2.1 Purchasing conditions
You declare to be 18 year old or older and to have the legal ability, or the parental authorization, to make a purchase on this Website.
Any purchase made on the Website must correspond to the normal needs of a family.
2.2 Order
After having validated your order, We will send You an email to confirm your order. We inform you of the sending of your products.
You can modify your order until the date of your order sending.
Article 3 : Price, availability and delivery
The prices shown on the Website are in Euros, with all taxes (French TVA and other applicable taxes), delivery price, order management and packaging costs included.
We can accept your orders in the limit of available stocks. We inform You of the availability of the products sold ont eh Website on each product information page. In case you choose to pay by check, your order will only be processed when your check is received and the delays start at the reception date.
If, despite ou vigilance, some products are unavailable, We will inform You by email as soon as possible.
(i) In cas of unavailability within the indicated period of time, We can propose You another product in substitution, with similar price and quality. In this case, the return costs implied by your use of your return right are at our expense. If We can not send you a product with similar price and quality, or if You do not wish it, You can cancel your order.
(ii) In case or permanent unavailability, and if We can not send You a product with similar price and quality, your order will automatically be cancelled.
Despite all our efforts, some products on our Website may have a price error. Be assured that while preparing your order, We will check the prices. If the correct price is lower than the price displayed on our Website, We will apply the lowest price and We will send You your product. If the correct price is higher than the price displayed on our Website, We will inform You and We will cancel your order unless you choose to accept the order with the new price.
Article 4 : Custom taxes
Any order made on the Website and shipped outside France can be submitted to taxes and custom costs. These taxes and costs are totally at your expense and under your responsability. We are not obliged to check and to inform you of the applicable taxes and custom costs. To know them, We advise You to contact the local authorities of your country.
Article 5 : Payment
You can pay your order by check ou by credit card.
The foreign credit cards issued out of France have to be international cards. In case of payment by credit card, the total amount of your order is debited when you purchase your products.
Payment by check is only possible for checks in Euros from a French bank. The check is sent to be credited on our bank account as soon as it is received.

In case your payment is delayed, We are authorized to claim interest rates, calculated on the legal rate basis and applicable from the date of the payment.
Article 6 : Returns
Your retunr right
According to the article L.120-20 et following ones of the French consumption code, You have seven (7) working days to exert your return right without having to justify your motives or to pay any penalty, except return shipment costs. The 7 day period of time starts at the reception of the products.
To cancel your order within a 7 working day period of time, please print a return label indicating "I do not want this product anymore". Please put the product in an adequate package to send it back to us.
We inform you that the additional services (like present boxes) can no be cancelled or reimbursed.
Article 7 : Property rights
The property of the shipped products will remain ours until their the products are given to the transportation company after your payment is validated.
Article 8 : Warranties and responsabilities
You are protected by the law on legal warranty and hidden defects.
We are not responsible of the fact that the delivered products do not respect the local legislation of the destination country other than France.
We commit ourselves to do whatever is possible for us to provide the adequate service to the customer. Nevertheless, our responsability can not be engaged in case of the non application of our contract obligations due to major force cases defined by the French law.
In case of small differences between the photographs, texts of our products presented on our Website, and the orderd products, our responsability will ne be engaged.
We do everythong is possible to provide the products and services of these terms and agreement. We are responsible of all direct and predictible damages when the Website is used or when the sale contract is concluded between You and Us. We are not resposible in any case of the commercial, data or profit losses, or of any undirect damages that were not predictible when the Website was used or when the sale contract was concluded between You and Us.
The above responsability limitation is not applicable in case of fraud or serious mistake from our part, in case of body damages or in case of defective products or non conformity (including hidden defects).
